1. Scope and contracting party

These Terms & Conditions (“Terms”) govern the use of the website hashempire.app (the “Website”) and the browser game HashEmpire accessible through it (the “Game”), a Bitcoin-mining idle simulation with no real-world monetary value.

By registering, accessing, or using the Website or the Game, you accept these Terms. Any conflicting terms you propose do not apply unless we have expressly agreed to them in writing.

2. Description of the service

HashEmpire is a free-to-play Bitcoin-mining idle simulation. Players purchase virtual ASIC miners, build a virtual mining farm, earn virtual BTC, sell it for virtual USD, invest in equipment, and may attack or defend against other players through a server-side PvP system.

All economically relevant values (balances, hashrate, yields, prices, events, attack outcomes) are calculated exclusively server-side. There is no entitlement to any particular availability, error-free operation, or continued development of the Game.

BTC and USD shown in the Game are purely virtual in-game currencies with no real-world value. Exchanging them for real money, cryptocurrency, or any other asset is excluded and is never offered or facilitated by us.

3. Registration and user account

A user account is required to use certain Game features. You must provide truthful information when registering; the email address you provide must belong to you, as it is also used to match HashCoin purchases (see section 6).

Keep your login credentials confidential. You are liable for actions taken using your credentials to the extent you are responsible for their misuse. Notify us immediately if your credentials are lost or misused.

Minimum age

The Game is not specifically directed at children. Users under 18 may only use the Game with the consent of a parent or legal guardian; this applies in particular to purchases under section 6, since minors generally have limited legal capacity to enter into such transactions without their guardians’ consent under applicable law. Parents/guardians are responsible for supervising minor users.

4. User obligations

Detailed, concrete fair-play rules are set out in our Game Rules. When using the Website or the Game, you must not:

• use bots, cheats, exploits, automation scripts, or manipulate client-server communication to unlawfully influence game values;
• create or operate multiple accounts to circumvent limits (e.g. daily contract or purchase limits) (“multi-accounting”), unless expressly permitted;
• exploit bugs instead of reporting them through Contact;
• harass, insult, or threaten other players, or engage in any other conduct that violates applicable law;
• attempt to gain unauthorized access to our servers, databases, or other users’ accounts.

5. Consequences of violations

Depending on the severity of a violation of these Terms, we may issue warnings, restrict individual features, correct game progress or balances (e.g. following a confirmed exploit), or temporarily suspend or permanently delete the affected account. HashCoins connected to a violation may forfeit in such a case; no refund is owed to the extent the violation is attributable to the user.

6. Premium Shop, HashCoins, and Ko-fi payments

6.1 HashCoins

HashCoins are a virtual premium currency within the Game. They are either awarded free of charge via the daily bonus or purchased for a voluntary payment through the external payment service Ko-fi (“Ko-fi”) and can then be spent in the Premium Shop for virtual benefits (e.g. an additional worker slot, attack protection, name change). HashCoins are not legal tender, cryptocurrency, or e-money, and can only be used within the Game. Cashing out, exchanging for real money, or transferring them to third parties is excluded.

6.2 Purchase processing via Ko-fi

Purchases of HashCoins are processed through the Ko-fi platform (Ko-fi Labs Ltd.). Ko-fi acts as a payment service provider in this context; depending on the specific technical setup of a given offer (e.g. a direct “support” payment vs. a Ko-fi shop product), the underlying purchase agreement may be formed directly with us, or — where the offer is made available through Ko-fi’s own shop feature — may additionally involve Ko-fi’s own terms of use and payment terms. In either case: once your payment has reached us or has been confirmed by Ko-fi, we credit the corresponding number of HashCoins to your game account.

We use the email address provided to Ko-fi to match your payment to your game account. If it differs from the email address on your game account, crediting may be delayed; in that case, contact support via Contact so the payment can be matched manually.

Ko-fi’s own current terms of use and privacy policy additionally apply, available at ko-fi.com. We are not responsible for the payment processing itself (e.g. card data); only Ko-fi’s and its payment partners’ terms apply to that part of the transaction.

6.3 Right of withdrawal

Information about your right of withdrawal as a consumer is set out in our separate Right of Withdrawal notice.

6.4 Prices and changes

All Premium Shop prices are final prices in the currency shown by Ko-fi at checkout. We reserve the right to change the content, prices, and availability of the Premium Shop at any time; HashCoins already purchased are not affected.

7. Availability and changes to the Game

We aim for uninterrupted operation but do not guarantee constant availability of the Website or Game. Maintenance, technical faults, or force majeure may cause temporary outages. We may adjust, extend, or discontinue game content, mechanics, values (e.g. prices for miners, contracts, or shop items), and feature scope at any time, to the extent reasonable for users.

We may permanently discontinue operation of the Game. In that case, we will announce this with reasonable notice via the Website or the Game. There is no entitlement to continued operation of the Game or compensation for unused, freely obtained game content. If paid HashCoins remain unredeemed at the time of a permanent shutdown, we will consider an appropriate case-by-case solution.

8. Intellectual property

All content on the Website and in the Game — including text, graphics, logos, depictions of game mechanics, and source code not marked as open source — is protected by copyright and, unless otherwise indicated, belongs to us or our licensors. Any use beyond ordinary gameplay (e.g. reproduction, redistribution, modification) requires our prior written consent.

9. Liability

We are liable without limitation for damages resulting from injury to life, body, or health caused by an intentional or negligent breach of duty, as well as for other damages caused by an intentional or grossly negligent breach of duty.

For damages arising from a slightly negligent breach of material contractual obligations (obligations whose fulfillment is essential to the proper performance of the contract and on whose observance you may reasonably rely), our liability is limited to foreseeable damages typical for this type of contract. Liability for slightly negligent breaches of any other obligations is excluded.

The above limitations do not apply where we have fraudulently concealed a defect, assumed a guarantee, or to claims under mandatory product liability law. Liability for the loss of virtual game progress or virtual game currency due to technical faults, data loss, or server outages is limited according to the principles above.

10. Changes to these Terms

We may amend these Terms with effect for the future to the extent necessary to adapt to changed legal or technical circumstances, or where new features require it. We will inform registered users of material changes in a suitable form (e.g. in-game notice or email) with reasonable advance notice. If you do not object within 6 weeks of receiving the change notice, the amended Terms are deemed accepted; we will specifically point out this right to object and the consequences of silence in the change notice.

11. Final provisions

These Terms are governed by the law of the Federal Republic of Germany, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer habitually resident in another EU member state, mandatory consumer-protection provisions of that state remain unaffected.

Should any provision of these Terms be or become invalid, the validity of the remaining provisions is unaffected.
